What is wrong with this analogy?
"The death penalty is a warning, just like a lighthouse throwing its
beams out to sea. We hear about shipwrecks, but we do not hear about
the ships the lighthouse guides safely on their way. We do not have
proof of the number of ships it saves, but we do not tear the
lighthouse down." (Judge Hyman Barshay of New York)
The analogy is meant to illustrate the fact that statistics cannot tell
us how many potential criminals have refrained from taking another's
life through fear of the death penalty. Do you agree with it? Discuss.
It's far-fetched. That's whats wrong with it.
Criminal minds don't think they will get caught. The threat of going to jail for 50 years should be just as deterring if we were talking about rational people, anyway.
To say someone who is agitated and wielding a knife doesn't use it because they fear getting executed, but would have used it if they would "only" end up as slave-labour for the rest of their life, is almost silly. To most people, that would both spell "disaster for the rest of your life". Some people might say this threat of being executed would only make them more determined- when they have crossed the line to being eligible to death -penalty, they feel they are "all-in", and might kill out of desperation, if they think this will reduce the probability of ever being caught.
Also, when it comes to the light-houses, you do get report of ship-captains saying it helped them. You don't get any reports from people saying "oh, I was thinking of killing somebody, but when I realized I was in a state where people are hung, I didn't do it". If you do get a report like that, there is no way to know that person would have killed if the max penalty had been jail for life.
