What subjects require permission in order for me to sell a commercial, editorial or art photo of it?
Besides many nature and landscape photographs, I have other ones with people, buildings, public art, lighthouses, etc. I realize there may or may not be differences between selling a photo as editorial, art and commercial. If you have experience regarding these issues in selling your photography then please share you words of wisdom. Thank you.
There are big differences in selling for editorial/art and commercial (advertising).
For the first generally no permissions are required, but for commercial people and objects subject to copyright usually require permissions.
Each case can be different depending on the subject and how they are portrayed in the image. If they are in the background and incidental then they are less likely to require permission, but if they are a prominent element then the most likely do require permission.
There are some odd contradictions. For example; rural landscapes with tractor or farm machinery generally do not require permission, unless they are made by John Deere - or so one of my stock libraries says.
Some buildings or architectural icons are protected by copyright provisions and need permission for commercial use such as advertising or on products such as t-shirts etc.
None of this is absolute or exactly defined, so you find many photographers and publishers tend to be extra cautious and insist on releases even when they do not need them. So get releases when you can.
